Terms of Service

Effective Date: March 1, 2026

1. Purpose of Our Service
Senior Year Inc. ("CozyText") provides non-medical, non-emergency wellness check-ins and communication tools designed to promote the well-being of seniors and peace of mind for their families. While our services are supportive, they are not a substitute for emergency services (911), licensed medical care, or professional caregiving.

2. SMS Messaging & TCPA Compliance
CozyText utilizes SMS (text messaging) as its primary delivery method. To comply with the Telephone Consumer Protection Act (TCPA) and mobile carrier safety standards:

User-Initiated Activation: Service for the senior recipient only begins once they send their unique activation code to our system. This act constitutes prior express written consent by the recipient to receive automated daily check-ins from CozyText.

Message Frequency: Subscribers will receive one (1) automated check-in message daily. Additional messages may be sent for enrollment confirmation, help requests, or missed check-in alerts.

Opt-Out: You may cancel the SMS service at any time by texting STOP to our number. You will receive one final confirmation text.

Carrier Liability: Mobile carriers are not liable for delayed or undelivered messages. Message and data rates may apply.

3. Third-Party Sign-Ups & Eligibility
You must be 18 years or older to purchase a subscription. If you are setting up services for another individual (e.g., a senior loved one):

You represent that you have the legal authority or have obtained express permission from the Recipient to enroll them.

You acknowledge that the service will not activate until the Recipient performs the "Digital Handshake" by texting their unique activation code to CozyText.

You agree to provide and maintain accurate contact information for yourself and the Recipient.

4. No Emergency Guarantee
Our daily check-ins are a routine method of contact only. While we make reasonable efforts to notify a designated contact if a check-in is missed, we do not guarantee the detection of emergencies, timely communication of alerts, or resolution of health or safety concerns. It is the sole responsibility of users and their families to maintain independent emergency plans.

5. Limitation of Liability
To the fullest extent permitted by law, Senior Year, Inc. and its affiliates are not liable for:

Any indirect, incidental, or consequential damages.

Any delay or failure to respond to check-in messages or alerts.

Any reliance on the platform as a sole method of monitoring or care.

Any loss resulting from carrier-level delivery failures.
By using our service, you understand it is provided “as is,” and you assume full responsibility for its use at your own risk.

6. Privacy & Data Sharing
Your use of this service is also governed by our Privacy Policy. Specifically regarding SMS: we do not sell or share mobile numbers or SMS consent data with third parties for marketing or promotional purposes.

7. User Responsibilities
By using CozyText, you agree to:

Ensure that designated emergency contacts are reachable.

Use the service only for lawful purposes.

Notify us immediately if the Recipient’s phone number changes.
Accounts may be suspended or terminated if they are misused or violate these Terms.

8. Modifications to Terms
We may update these Terms to reflect changes in service or legal requirements. We will update the “Effective Date” above. Continued use of CozyText services after changes take effect constitutes your acceptance of the updated terms.

9. Dispute Resolution
Any disputes arising from these Terms shall be subject to the laws of the State of Delaware. You agree to resolve any legal disputes through binding arbitration or mediation, unless prohibited by local law.
