1. Purpose of Our Service

Senior Year provides non-medical, non-emergency wellness check-ins and communication tools designed to promote the well-being of seniors and peace of mind for their families. While our services are supportive and caring, they are not a substitute for emergency services, licensed medical care, or professional caregiving.

Important: In the event of an emergency, always call 911 or your local emergency response service.

2. No Emergency Guarantee

Our daily check-ins are designed to promote general well-being and offer a routine method of contact. While we make reasonable efforts to notify a designated contact if something appears unusual, we do not guarantee detection of emergencies, timely communication, or resolution of health or safety concerns.

It is the responsibility of users and their families to maintain appropriate safety measures, emergency plans, and medical or caregiving services as needed.

3. Limitation of Liability

To the fullest extent permitted by law, Senior Year, Inc. and its affiliates, officers, employees, or agents are not liable for:

- Any indirect, incidental, special, or consequential damages

- Any delay or failure to respond to check-in messages or alerts

- Any reliance on the platform as a sole method of care or monitoring

- Any loss or compromise of user data

By using our service, you understand and agree that it is provided “as is,” and you assume full responsibility for its use at your own discretion and risk.

4. Modifications to Terms

We may update these Terms of Service from time to time to reflect changes in our services, legal requirements, or internal policies.

- We will update the “Effective Date” above.

- For material changes that affect your rights or responsibilities, we will notify users at least 7 days in advance via email or our website.

Continued use of Senior Year services after changes take effect constitutes your acceptance of the updated terms.

5. User Responsibilities

By using Senior Year, you agree to:

- Provide and maintain accurate and current contact and check-in information

- Ensure that your designated emergency or support contacts are reachable

- Use our services only for lawful and appropriate purposes

Accounts may be suspended or terminated if they are misused, or if they violate these Terms.

You may use Senior Year on behalf of another person (such as a senior loved one) if you have appropriate consent or legal authority to do so.

6. Eligibility

You must be 18 years or older or have the legal authority to accept these Terms on behalf of a senior participant. If you are setting up services for another individual, you represent that you have their consent to do so.

7. Privacy

Please refer to our Privacy Policy for details about how we collect, use, and protect your personal information.

8. Dispute Resolution

Any disputes arising from these Terms or the use of our services shall be subject to the laws of the State of Delaware, without regard to conflict of law provisions. You agree to resolve any legal disputes through binding arbitration or mediation, unless prohibited by local law.
